Terms and Conditions
These Terms govern the sale of goods through viamercader.com by Nana lab s.r.l.. They describe how an order is made, how it is paid and delivered, and the rights you have as a consumer.

In these Terms, “we”, “us” and “Viamercader” mean Nana lab s.r.l.. “You” means the person placing the order. These Terms are written for consumers: people buying for purposes outside their trade, business or profession.
2. What these Terms cover
These Terms apply to every order placed through this website and to the sale of the goods presented on it. By sending an order request you accept them. They should be read together with our Privacy Policy, Shipping Policy, Refund Policy and Cookie Policy.
3. The products
The products are consumer goods for the home and the garden. Each product page states what is included in the box and the essential characteristics of the item. Photographs are illustrative: colours may look different on your screen and accessories are only included when the page says so.
We describe what a product does and we do not attribute to it properties it does not have. Our products are not medical devices and we make no health claims about them. Availability varies by country, and a product shown on this site may not be available where you live.
4. Prices
Prices are shown on the page of each product, in the currency of the country the page is addressed to, and they include VAT where VAT applies. Any delivery cost is separate and is communicated to you before the order is confirmed, as described in the Shipping Policy. The price that applies is the one confirmed with you during the confirmation call.
5. How an order is made
- You send an order request through the form on a product page, giving your name, telephone number and delivery address. This is a request, not a purchase: at that moment nothing is due.
- An adviser calls you to check availability, the delivery address, the delivery date and the total amount payable, including any delivery cost.
- The contract is concluded when you confirm the order during that call, or when you confirm it in writing. From that moment the order is binding for both of us.
- We may be unable to accept an order, for example if the item is no longer available, if the address is outside our delivery area, or if we cannot reach you by telephone after several attempts. If that happens, nothing is owed by either side.
6. Payment
The payment methods available are stated during the confirmation call. Where cash on delivery is offered, you pay the courier when the parcel is handed over; the courier may accept cash only, or cash and card, depending on the country. We never ask you to send money to a personal account, and we never ask for your card details by email or by telephone.
7. Delivery
We deliver to the address you give during the confirmation call. Dispatch, delivery times, delivery costs and what happens if a delivery fails are set out in the Shipping Policy, which forms part of these Terms. Risk in the goods passes to you when you, or a person indicated by you, take physical possession of the parcel.
8. Right of withdrawal
If you are a consumer, you have the right to withdraw from a distance contract within 14 days of the day on which you take physical possession of the goods, without giving a reason. This right comes from Directive 2011/83/EU and, in Italy, from the Consumer Code (Legislative Decree 206/2005).
In addition to that statutory right, we voluntarily accept returns for 30 days from delivery, under the conditions set out in the Refund Policy. The longer period is a commercial offer of ours and does not reduce your statutory rights.
To withdraw, write to info@viamercader.com before the period expires, stating your name, the telephone number used for the order and the product concerned. You may use the model withdrawal form annexed to the Directive, but you are not obliged to. We then send you the return address. Unless the goods are faulty or were sent in error, the cost of returning them is yours.
Some goods cannot be returned once unsealed, in particular sealed goods which are not suitable for return for reasons of health protection or hygiene. These exceptions are listed in the Refund Policy.
9. Legal guarantee of conformity
Goods sold to consumers are covered by the legal guarantee of conformity for two years from delivery. If the law of the country where you habitually reside grants a longer period, that longer period applies. Within that period, if the goods do not conform to the contract, you are entitled to have them repaired or replaced and, where that is not possible or proportionate, to a price reduction or to end the contract. The guarantee does not cover normal wear, damage caused by misuse, by an accident, or by a repair carried out by someone other than us.
To make a claim, write to info@viamercader.com describing the defect and attaching a photograph.
10. Our liability
We are liable for foreseeable loss and damage caused by our failure to comply with these Terms or by our lack of reasonable care. We do not exclude or limit our liability in any way that the law does not allow, and in particular we do not limit liability for death or personal injury caused by our negligence, for fraud, or under the rules on defective products. We are not liable for delays caused by events outside our reasonable control, such as extreme weather, strikes, or the failure of a public network; if such an event occurs, we tell you and agree a new delivery date with you, or refund what you have paid.
11. Complaints and disputes
Write to info@viamercader.com first: most problems are solved in a few messages, and we answer complaints within fourteen days. If we cannot find a solution, you can submit the dispute to the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
12. Applicable law and jurisdiction
These Terms are governed by Italian law. If you are a consumer resident in another Member State of the European Union, you keep the protection of the mandatory rules of the law of your country of residence, and you may bring proceedings before the courts of the place where you live.
13. Other terms
- If a provision of these Terms is found to be unlawful, the remaining provisions stay in force.
- We may update these Terms; the version that applies to your order is the one published on this page when the order was confirmed.
- The texts, photographs and graphics published on viamercader.com belong to Nana lab s.r.l. or are used with the permission of their owners, and may not be reproduced without our written consent.
- You may not resell the goods bought through this website in the course of a business.
